What is Mediation

Mediation is a process where a mutually agreed upon and neutral third party (called a mediator) assists and guides the parties towards resolving their differences outside of a formal courtroom setting.

Role of the Mediator

The mediator's role is not to make decisions for the parties or assess any blame. A mediator's role is to foster constructive dialogue and effective respectful communication to help guide and empower the parties towards reaching a mutually agreed upon resolution to their dispute.

Benefits of Mediation

Submitting a case to mediation has many benefits, including:

  • Reduced Cost: Mediation is generally less expensive than traditional litigation and can save thousands of dollars in attorney's fees, court costs and other costs of litigation.

  • Faster Resolution: Mediation can be scheduled significantly quicker than court hearings and gives the parties, not the court, control over the timing of the process.

  • Confidentiality: Mediation is completely confidential allowing the parties to keep their lives private, which allows parties to share their information more freely and openly.

  • Preservation of Relationships: Mediation can assist parties in maintaining and improving existing relationships.

  • Informal: Mediation is an informal and flexible process with less rules to adhere to, allowing for more creative solutions to disputes.

  • Empowerment: In mediation, parties have more control over the ultimate outcome, rather than a judge or other third party, empowering parties to create solutions that best work for them.

What is Arbitration

Arbitration is a procedure where a dispute is submitted, by agreement of the parties, to a neutral and impartial third party, who makes a binding decision on that dispute.

Role of the Arbitrator

The arbitrator's role is to hear both sides of the dispute and make a binding decision like a judge. This is a more formal setting than mediation, but it is still less formal and inflexible than the traditional court process. As a former District Court Judge, our Mediator Justin Haenlein, is well equipped to handle this role.

Benefits of Arbitration

Submitting a case to arbitration also has many benefits, including:

  • Reduced Cost: Arbitration is generally a more streamlined and flexible process than a formal court hearing, resulting in reduced attorney's fees and other costs of litigation.

  • Faster Resolution: Arbitration can generally be scheduled and completed on a much quicker timeframe than scheduling a court hearing.

  • Confidentiality: Arbitration is completely confidential. This process may be beneficial to parties or businesses who want to keep trade secrets or their private lives private.

  • Flexible: Parties in arbitration have more control of the discovery process and rules of evidence, allowing for greater flexibility in the process.

  • Enforceability: An arbitration award is a final and enforceable document, just like a court order, giving you finality in your dispute.
